UPON the Tribunal’s Order dated 27 April 2021 (the “Restriction Order”), which is annexed to this Order as Annex 1

AND UPON hearing Leading Counsel for the Claimant, Leading Counsel for the Respondents and Leading Counsel to the Tribunal at a hearing held from 19-23 and 26-27 April 2021

AND UPON hand down of judgment of the Tribunal on 30 September 2021

AND UPON the Tribunal granting the Claimant’s application to amend the Restriction Order

IT IS ORDERED THAT:

1. Paragraph 2 of the Restriction Order shall be amended as follows:
   1. Paragraph 2.2 of the Restriction Order shall be amended to state: “The Parties to this claim and their legal representatives in this claim and in the UCPI”.
   2. Paragraph 2.3 of the Restriction Order shall be amended to state: “A witness in this claim and their legal representatives in this claim and in the UCPI, for the purpose of their giving evidence in this claim or to the UCPI”.
2. Paragraph 3 of the Restriction Order shall be amended such that an individual shall not be a Relevant Person for the purposes of the Restriction Order if they have consented to an act of disclosure, publication or reporting which would otherwise be prohibited by Paragraph 1 of the Restriction Order. To that end, the persons listed in Paragraph 1 of this Order are permitted to inform a Relevant Person that their name appears in the Documentation.
3. The following were referred to extensively in the course of the OPEN hearing and in the Judgment, and may be shared by the parties accordingly, subject to the Restriction Order:
   1. The Parties’ Skeleton Arguments and any notes submitted to the Tribunal in OPEN;
   2. Any witness statements relied upon by the Claimant (and their exhibits);
   3. Any OPEN witness statements relied upon by the Respondents (and their exhibits); and
   4. The documents disclosed into OPEN by the Respondent.
